Terms of Service

These Terms govern your use of opsentry.io and the Opsentry service (the "Service") operated by Opsentry ("we", "us"). By signing up or using the Service, you agree to them.

1. The Service

Opsentry is an availability monitoring and incident communication platform. It probes endpoints you configure, helps your team manage incidents and maintenance, and publishes a status page to your users.

2. Your account

• You must be at least 16 years old and able to enter a contract.
• You are responsible for keeping your credentials secret and for activity under your account.
• You will give us accurate information and keep it current.

3. Acceptable use

You agree not to:

• Use the Service to monitor endpoints you do not own or have explicit permission to probe.
• Interfere with the Service, attempt to bypass rate limits, or reverse-engineer it.
• Send notifications to people who have not subscribed, or use the Service to send spam.
• Upload unlawful, infringing, or malicious content.
• Resell the Service without our written agreement.

We may suspend accounts that breach these rules. Egregious abuse may result in immediate termination.

4. Your content

You retain ownership of your data and configuration. You grant us a limited license to process it solely to operate the Service. You are responsible for ensuring you have the right to upload anything you upload, and for honoring your own users' rights (e.g. subscriber unsubscribe requests).

5. Fees

Pricing details, including any free tier, will be published on the pricing page when paid plans launch. Until then, the Service is provided to early users on an as-is basis. We will give at least 30 days' notice before charging for usage you have already configured.

6. Service availability

We aim for high availability but do not commit to a specific uptime SLA at this time. We may perform maintenance with reasonable notice and may make changes to the Service over time.

7. No warranty

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of liability

To the maximum extent permitted by law, Opsentry will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Service. Our total liability for any claim is capped at the greater of (a) the fees you paid us in the 12 months before the claim or (b) USD 100.

9. Termination

You may cancel at any time from the admin settings. We may suspend or terminate the Service for material breach with notice, or immediately for severe abuse. Upon termination, you can export your data within 30 days; afterwards it will be deleted.

10. Changes

We may update these Terms. Material changes will be announced at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

11. Governing law

These Terms are governed by the laws of [JURISDICTION TO BE SET BY COUNSEL]. Disputes will be resolved in the courts of that jurisdiction, except where mandatory law gives you the right to a local forum.
